STRATEGIES OF INFORMATION TECHNOLOGY APPLICATIONS

FOR JUDICIAL BRANCH
PERIOD OF 2013 – 2015
I. TARGETS, AN OVERVIEW
1. Targets, In General
-

Applications of Information Technology (IT) in Judicial Branches of the

Ministry of Justice and the Local Civil Enforcement Departments aim to increase the
efficiency of the both management and direction of effective exchange pocesses of
print documents, as well as electronic documents in the network environment.
-

To provide legal information as well as online public administration

services for both individuals and organizations to make the operation of the Judicial
branches of transparency, economical bubgets, efficient and personal services and well
organized operations.
-

To boost the coordination between the Ministry of Justice with the other

Governmental ministries, branches, local authorities, organizations and individuals in
society through electronic information system applications.
2. Targets, In Particular
a. Appications of Information Technologies in Judicial Branches
-

Electronic Documents exchanging via network tools:



Boosting of applications of electronic documents instead of print documents in
the managements, directions as well as administrations; gradually apply to the
electronic text-based referring documents and create network working environment;
fully apply the techiniques Managemential softwares and Operating documents for
Working and Management processes such as: electronic mails, softwares specialized
to serve the professional services; using the Internet to exploit information for
professional activities. Targets to achieve 100% of officers and employees of each
Units of Ministry, Agencies and Local civil judgment enforcement Departments, who
can proficient use of electronic mail for professional works; As well as to achieve
totally 100% of the Units in the Justice Ministry and the Civil judgment Enforcement

Department to apply document management softwares and operate in a network
working environment. The percentages of document electronic exchange rate over the
90% achievements.

Applications of Information technology in the direction, administration,

administrative tasks:
+

To ensure that 100% of the total information of direction and

administration of the Ministry of Justice are exchanged and posted to the E-portal of
the Ministry of Justice via Ministry of Justice Portal. Moreover, ensure that 100% total
of the information, transactions between each Units of the Ministry and confirm that

90% of the total information and transactions between with the Local civil judgment
enforcement departments is done in the network working environment.

Strategies to 2015, most of the conferences of the Ministry of Justice

with its local Units will be done via electronic multimedia conferences;
+

Ensure that 100% total personnel files of the civil servants in each

Judicial branch, business documentary records, statistical reports, complaints and
denunciations in each local civil judgment enforcement files, family and nationality
documentary and file managements, such as: citizen files, judicial files, information
about adoptions, foreign adoptions and other documentary fields via electronic data
management.
b.

Applications of Information technology for individuals and organizations
-

Ensure that the majority of local civil services under the jurisdiction of

the Ministry of Justice that offered at the 3rd level and published on Ministry of
Justice Portal, an E-portal.

Ensure that the portal of Ministry of Justice be full serviced information

about laws, policies, regulations, administrative procedures, workflow, project

investment, bidding and procurement, information activitiesof units under the
provisions of Article 28 of the Vietnam Information Technology Law System.
Individuals and organizations have to enable to access information sources related to
the operation quickly, easily. The information provided on the Portal of the Ministry of

Justice are to be updated daily as well as to accurate its completeness and accuracy of
updated information.

Create tools to receive complaints, suggestions and dialogue forums

through online portal of Ministry as well as Judicial Branches. To encourage both
individuals and organizations could access any online services and electronic media
facilitate transactions to exchange opinions with the local judicial authorities.
c. Applications of Information technology in the platform field of infrastructure for
E-government strategies

Coordinate with relevant IT units, as well as use IT purposed data of

communication networks and connect the information systems of the Units, agencies
and local civil judgment enforcement departments of the Ministry to ensure the
Information safety and security to meet information exchange requirements within
Units of the Ministry and between the Ministry and other Governmental
Admisnistrative agencies.

Develop and build the standards in the Judicial branches of information

technology applications on the basic national information standards, to ensure that the
designs, IT infractracture, seeking information exchanged between application fields
in industrial developments and other Governement agencies to be uniform and
systematic.

Applying the digital signature authentication service authentication and

digital nationality code that will be recorded in each document, which is transmitted
over the network to easier refer and management national document system.
II. SCOPES OF APPLYING IMPLEMENTATIONS
Implementation for The Units of the Ministry of Justice, the Local Civil
Enforcement Departments is planned. Particularly, the Local Judicial Branches, it
based the contents of this Applications of IT for Judicial Branches and the Application
of information technology strategies for 2011-2015 with Provinces and Cities to build
strategies of IT applications per each Unit suitably.
III. CONTENTS & APPLICATION PROCESSES
1. IT Infrastructures

Upgrading and improving infrastructure to meet the implementations of IT
applications in the Judicial Branches, as well as ensuring the information systems
running and applying systematicaly and safely.
1.1 IT Infrastructure Developing:
-

Supplying IT Equipments, and upgrading LAN Systems at the


Headoffice of the Ministry of Justice, as well as ensuring that IT systems of LAN
connections totally connected and highly speeded.
-

Seeting up the wide network system for Justice Sector: confirming the

connection from each linked unit that located outside the Headoffice of the Ministry
of Justice; the Offices of Civil Judgment Enforcement Departments of their Data
Centers, and gradually building network systems for Justice sector.
-

Supplying systematically the Server equipment, security software,

setting up networking model for the Civil Judgment Enforcement Departments,
ensuring convenient to share resources, safety and security of information.
-

Periods of implementation: period of 2011-2015.

1.2. Upgrading and Developing the Data Center (DC) for Ministry of Justice:
+

Upgrading the IT security as well as information security: upgrading

Security network system, supplement and replace the fully depreciated

(servers, network devices, security devices, other supporting auxiliary equipments).
+


To ensure that information systems operating stably, and prevent effectively

the attack from outside damaged IT system;
+

To control the circulated information that transferred on the network and

accessed via the Internet from the inside and outside environment;
+

Monitoring the accessions from the clients to the servers and to the other

machines in the Network;
+

Ensuring that the Units under the Ministry of Justice could be able to share

information with a high level of IT security, as well as confirming IT loss prevention
on transmission, indentifying objects sending and receiving information;

Enhancing high availability for information systems of both databases and

applications and system services;

To coordinate with Government: coordinating between the National

Cyber Security Centers and the Government Commission (under Vietnam Ministry of
Home Affairs) in building, deploying electronic authentication system and digital
signature system in the Ministry of Justice; Building and applying public integrated
key infrastructure. Moreover, closed coordination with the Ministry of Information
and Communications and the Ministry of Public Security in ensuring the safety and
security of information of system;

Promulgating procedures: Safety and security of information systems;

backup storage, data security protection;

Data Centers (DC)

Information systems, shared software applications (personnel management

system, document management system and operating documents) are located in the
Center for Data Integration Center under its managements and operations. In addition
to, the backup system is set up with highly availability of the Data Integration Center
and under managed of Ministry of Justice. Besides the saved information system Data
Integration Center, Ministry of Justice builds an additional reserved backup case in
case of a disaster of IT.

Public service system (the system / application software allows the connection,

Internet access from the outside to provide services to individuals, organizations): will

be placed in the Data Center Data Center-DC provider of services, greatly reducing
the cost of investment in infrastructure, equipment, management, human resources,
operational and supporting incidents.

Supplementing and upgrading the software system: Microsoft Windows

Server 2008 from 32 bit to 64 bit, 64-bit Microsoft SQL Server 2008, Oracle Database
10g Standard Edition, Microsoft BizTalk Server Standard ... to meet the development
requirements of information system of the Ministry of Justice.

Investing Infrastructurers for Integrated Data Center: Integrated Data

Center needs to be invested in facilities such as a room spaces and IT equipments,

electrical systems, security system, etc that dedicated exclusively to ensure operations
of Center.

1.3. Additional Investments for Units of Equipment and Local Civil Enforcement
Departments
Supplementing or replacing the equipments to ensure standards and volumes
for equipments and facilities of agencies and officials, prescribed public servants.
Ensuring that each staff, civil servants and employees of the judicial branches are

equipped with a 01 PC / person (according to the Judicial Scheme of Ensuring
working equipment and facilities for agencies, units of the judicial branches of the
period 2011 - 2015).

1.4. Expanding and exploiting efficiently of electronic media network conference
systems:
Exploitating and applying efficiently use of electronic network media
conference systems was equipped with multimedia. Additional investments in
expanded multimedia system for weekly conference from 3 points of media bridges 7
to 7 and 10 points.

2. Applications of information technology in the Judicial Branches
-

Softwares of Office document managements and operating Managements:

Upgrading and deploying softwares to the Department of Civil Enforcement.

Softwares of Statistics sharing in the Justice sector: applying for statistical


services of the State's criteria and according to the norms of the judicial branches

Softwares of recorded Civil Case Files: to implement the applications of

information technology to support t professional profile civil judgment managemen in
civil judgment enforcement agencies locally.

Database of adopted children and adoptive parents: Supporting the

management of Government for adoption.

Information on civil status system: In order to improve the management of

civil status, the report provides information and statistics: birth, marriage, death, ... to
build database on civil status.

The system of the civil judicial information: unified management from central

to local levels for civil judicial works, grually apply and complete database of civil
judicial records.

Database of Commercial Arbitration: Forming databases of nationwide

Developing overall information management system: To comply with the


national program on the application of information technology in the operation of the
agency for the period 2011 - 2015 and the guidance of the Ministry of Information and
Communications.

Software of HR management and judicial positions: software, electronic data

form the basis for personnel records, civil servants and employees of the judiciary.

Building software on the work of emulation and commendation: efficient

service in the emulation and commendation in the Justice Sector.

Upgrading and completing softwares and databases of citizenship: In order to


build the database nationality uniform, the uniform data management through the
integration of data from the Department of Justice.

Software of complaint and denunciation Management about the civil

judgment: to support the management of settlement of complaints and denunciations
about the enforcement of civil judgments. During the deployment process will work
closely with the Government Inspectorate ò Vietnam and local authorities to take
advantage of and ensure compatibility voiHe management information system of
complaints and denunciations of the Government Inspectorate and the local.

Database of Property Auction: Establish Database on auction properties across

the country.

Upgrading Software of organizational Management and legal assistance

activities and build legal assistance databases: To strengthen the computerization of
legal assistance, the uniform data management fromthe legal aid center serving the
general industry statistics.

- Software of systematization of the text: to support the examination, review and
systematization of legal documents, the first step to create the database related tothis
work.

3.

Applications of IT for Individuals and Organizations

3.1. Completing Ministry of Justice Portal
Electronic IT portal for Ministry of Justice needs to be supplemented to meet
the technology platform provides administrative services level 3, integrate information
from the national database and other specialized supplementsthe information in the
field of state management of the Ministry of Justice, to meet administrative services at
a high level, providing the information to the Government Portal prescribed;

shareinformation with other administrative agencies in a complete, accurate and
timely; clue connected activities provide information on the function of the Ministry
of Justice.
Upgrading information Websites the civil judgment enforcement in accordance
with the functions, tasks and organizational structure of the General Department of
Civil Judgment Enforcement Department of Justice, build and integrate the private
information of the websites for civil Enforcement Departments.
3.2.

Periods of implementation: periods 2011 - 2015.

Providing online public administration services at 3 levels:
Currently, in according to providing information on the activities of the

Ministries and the relevant legal information, etc, all public services in the field of
management by the Ministry of Justice has been deployed on the portal of the
Ministry (2rd level). In 2011-2013, the Ministry of Justice is expected to increase the
supply of public services to third level and pilot public private partnership model
(study proposed mechanism, the legal framework, policies to ensure the rights of

enterprises involved in the project; support enterprises to maintain and exploit the
pilot group services) for the group of the following public services:
3.2.1. Registration of security transactions: Currently, the National Registration
Department secured transactions ongoing project to build the material and technical
basis for the national registration system transactions secured by loans from ADB. In
particular, the provision of registration services online transaction.

3.2.2. Judicial Assistances: Providing administrative services in the fields of lawyers,
notaries and property auctions, including:
+ Appointment of notaries;
+ Level auction practice certificate;
+ Certification practice law;
+ Licensing established for foreign lawyers organizations in Vietnam;
+ Licensing foreign law practice;- Periods of implementation: periods 20122015.
3.2.3. Judicial Assistances: including services, following:
+ Request for legal assistance
+ Get results of legal assistance
+ Sign up to participate in legal assistance
+ Sign up to participate as collaborators legal assistance

Periods of implementation: periods 2012-2015.

3.3. Building Information Systems for unified legal documents from the central to
the local committees
Coordinating with Ministries, Judicial branches and localities to build
centralized database to store all legal documents of our country from 1945 to present.
As well as building data entry environment and unified legal data from the Central to

the Local systems, the abilities to share information that provides fast, correct and
timely of information on legal sector. Which its documents of dissemination,

implementation and law enforcement agencies, to meet the requirements of economic
management, social management Assembly of agencies, organizations and
individuals; while creating favorable conditions for the strata understanding of the
law, to live and work in accordance with the Constitution and law.

4. HR for IT applications and Developments
4.1. IT Human Resources
-

To add the necessary HR for the Information Technology Department;

consolidation, allocation of the payroll officer in charge of information technology for
its units have deployed several applications of information technology, the
Department of civil Enforcement (01 requirement);

To develop and implement HR training programs consistent with the

needs, progress and results of the application of information technology in the
activities of the Ministry of Justice; training a systematic way of computing the
documents and information office for staff and public servants;
-

To plan of training HR in charge of information technology and

encouraged to take the necessary staffing the officer in charge of information
technology to the successful implementation of projects of information technology

applications in performance of the Ministry; training and retraining of staff in
information technology management, has mastered the professional activities of the
judicial branch has knowledge of information technology and the ability to organize
effective application of information technology activities of ministries. The
curriculum includes:
+ Training network administrators, system administrators.
+ Training for officers in charge of security, safety, security and technical staff
to ensure the system.
+ Training project management, analysis and design of information systems
under the framework program by the Ministry of Information and Communications.

+ Training, training in the skills necessary for the officer in charge of the
information technology industry; managers and staff editor of news and articles for
the unit's electronic information .
+ To improve knowledge of the judicial branch for information technology
professionals working in the units of the Ministry.
+ Training for Organization of experience, and communication skills to raise
awareness of the leaders of the unit; officials and employees in the industry.Periods of implementation: periods 2012-2015.
4.2. Improving knowledge of information technology applications for IT Human
Resources
-

Annually, plans of training and retraining for approximately 25 - 30% of

official HR of the Ministry of Justice of the application of information technology
skills and new technology achievements related tojudicial sector. 100% of HR are
trained to use and exploit the new apps in the application softwares. Concentrating on
Information technology training for the civil judgment enforcement of Human

Resources and specially, leaders they must be certificated as the Jusdicial Department
experts.
In addition, focusing on some of these following:
-

Increasing the amount of information technology applications in the judicial

training institutions under the Ministry of Justice;

Recruitment of new staff to meet the benchmark of the skills of information

technology applications;

To

disseminate

basic

knowledge

of

information

technology

and


communication, raising awareness about the application of information technology on
the electronic information component of the electronic portal.

IV. RECOMMENDATIONS

1. Financial Recommendations

Starting up with different domestic and foreign sources to develop the

technological infrastructure, the implementation of priority projects focus on the
application of information technology in the judicial branch; actively seeking ODA
(official development assistance) and cooperation with foreign countries to carry out
large projects, large-scale deployment.

Investment contracts for hardwares, software, database and training tools.

Annual plans from Ministry of Justice coordinate with the Ministry of

Information and Communications, the Ministry of Planning and Investment, Ministry

of Finance facility to allocate sufficient funds and investment business funding for
technology application project information under this plans.

Implementing Recommendations
Standardizing business processes in the sectors of Government management

activities. Promulgating regulations to provide, exchange, collect information in the
ministry. Starting administrative reforms in line with the program and grually form as
well as be available the electronic administration of the judicial branches;

Promoting the roles of the units in charge of information technology

Information Technology Department to advise and assist the Minister of Justice
unified management of information technology applications in the industry; clue
implementation the application of information technology in the areas under its

The units of Ministry of Justice, agencies and local civil judgment enforcement

departments should be coordinated closely with the Department of Information
Technology to ensure consistently and high efficiency in the applications of
information technology per units;

The Local Judicial Branches based on the contents of this plan and its


application of information technology plan 2011-2015 per provincial / municipal
supports to make the applying plans of IT developiments suitably.

Organizational Recommendations

To complete the applications of information technology at total system of

Justice sector.

Increase understanding, awareness and responsibility of officials and public

servants in ministries and agencies, local civil judgment about the role and utility of
the application of IT beliefs.
4.

Supporting Policy Recommendations

-

Need to have direct involvement and strict guidance of the leaders in the

introduction of information technology applications in the activities of the Ministry.
The formulation, approval and implementation of projects of information technology

applications need to match the contents of the plan general application of information
technology and in accordance with practical needs, inheritance is the result of the
project has developed prior to the product of the project appropriate and consistent
with the goals of the proposed master plan. Creating a unified information
environment with the coordination bond between the different areas of activity in the
judicial branch, between the central and local levels, between the judicial branch and
other branches base for development cooperation information infrastructure, data

Article 2. Implementations

1. The Units of the Ministry and the Civil Enforcement Local Civil
Enforcement Departments shall:
- Requesting to computerize and update the datas for the applications of IT is
deployed per each unit.
- Exploitatiing and creating the update information by the organization
managements, specialized information systems used by the Ministry.
- Proposing electronic sample forms that are used to collect, aggregate
information services of the Government managements by functions and tasks of the
Units in the Ministry.

Appointing staffs to participate in training courses using information

technology.
-

Coordinate with the Information Technology Department in the

implementation of this plan and use the results of the project plan for the professional
service.
2. Department of Information Technology ImplemetingDuties:
-

To assume the prime responsibility and coordinate with the relevant unit guide,


inspect and supervise the implementation of this Plan; annual preliminary
implementation and propose specific solutions to solve the problemsconstraints and
obstacles in the implementation process, the leadership of the Ministry.
-

To lead and coordinate with relevant agencies to develop projects for the tasks

in the plan submitted to the Ministry for approval.
-

To apply Construction and the Ministry issued the text promote application

information technology dungcong in the judicial branch and the rules and regulations
on the application of information technology management of the Ministry of Justice.

To boost the organization, capacity building team in charge of information

technology to meet the requirements of information technology applications.
-

To study the suitability, compatibility and standards specified database,

standard technology, electronic portals, information systems ... to ensure the smooth
operation of the system on a national scale.

To organize, coordinate and guide the unit in the Ministry of Justice applied the

results of this plan.
3. Department of Planning and Finance Implementing Duties
Application on the basis of the Plan's annual information technology ministries,
the Planning and Finance Department implement policies to mobilize domestic and
foreign capital for the development and application of information technology;
balanced, shall allocate the budget was balanced in the annual budget estimates for the
project components in the Planning application information technology in the
operation of the judicial branch for the period 2011 - 2015; guidance related units
disbursement schedule vatuan by the provisions of the law.
4. Department of Organization and Personnel implementing Duties
-

Researching and recommend the proposal in the distribution of information

technology HR.

Develop mechanisms and preferential policies for the officer in charge of

information technology industry.
5. Civil Enforcement Departments Implementing Duties
-

To coordinate with the Department of Information Technology dissemination,

guidance Civil Enforcement local plan implementation.

To assume the prime responsibility and coordinate with the relevant units to

implement the assigned project and design the uniform electronic forms for Judgment
Enforcement Agencies.

To supervise and urge the Civil Enforcement local implementation plan.

6. Administrative Department of Justice implementing duties:
In collaboration with the Department of Information Technology to develop and
implement the assigned projects in the field of civil status, nationality and judicial
fields.
7. Department of Judicial Assistance implementing duties:

In collaboration with the Department of Information Technology to build
deployment projects assigned and implement online public administration services in
the field of notaries, lawyers, property auction, commercial arbitration.
Article 3. This Decision takes effect from the date of signing.
Article 4.

Chief of Office, Department of Information Technology, the heads of

units of the Ministry, Department of Civil judgment of provinces and cities directly
under the Central Government shall have to implement this Decision.
