THƯ BẢO LÃNH HOÀN TRẢ TIỀN ỨNG TRƯỚC
ADVANCE PAYMENT GUARANTEE
Kính gửi (To): …………………………….(“Chủ đầu tư”) (the “Employer”)
Theo điều khoản về tạm ứng nêu trong điều kiện cụ thể của Hợp đồng (Pursuant to the advance
payment term of the Contract) …………….,…….. [Ghi tên và địa chỉ của Nhà thầu (Name and address
of the Contractor)] (sau đây gọi là “Nhà thầu”)(hereinafter referred to as the “Contractor”) phải nộp
cho Chủ đầu tư một bảo lãnh ngân hàng để bảo đảm Nhà thầu sử dụng đúng mục đích khoản tiền
tạm ứng (has to provide the Employer a bank guarantee in order to ensure that the Contractor shall use the
advance payment for the stated purpose) ………. [Ghi rõ giá trị bằng số, bằng chữ và đồng tiền sử
dụng (In numbers, in words and type of currency) ] cho việc thực hiện Hợp đồng (in performing the
Contract);
Chúng tôi (We), Ngân hàng .......(the …Bank) – Chi nhánh ………….. (Branch) (“.......ank”) có trụ sở
đăng ký tại (having registered office at) ……………. [Ghi địa chỉ của Đơn vị phát hành (Address of
Issuing Branch)], theo yêu cầu của Chủ đầu tư, đồng ý vô điều kiện, không hủy ngang và không yêu
cầu Nhà thầu phải xem xét trước, thanh toán cho Chủ đầu tư khi Chủ đầu tư có yêu cầu với một
khoản tiền không vượt quá (as requested by the Employer, unconditionally and irrevocably accept and do
not request the Contractor view in advance, to pay for the Employer any amount not exceeding ……. [Ghi
rõ giá trị bằng số, bằng chữ và đồng tiền sử dụng (In numbers and in words and type of currency) ] upon
receipt of the Employer’s demand) .
Ngoài ra, chúng tôi đồng ý rằng các thay đổi, bổ sung hoặc điều chỉnh các điều kiện của Hợp đồng
hoặc của bất kỳ tài liệu nào liên quan tới Hợp đồng được ký giữa Nhà thầu và Chủ đầu tư sẽ không

làm thay đổi bất kỳ nghĩa vụ nào của chúng tôi theo Thư bảo lãnh này.
Otherwise, we agree that no change or addition to or other modification of the terms of the Contract or of
any documents related to the Contract which may be made between the Contractor and the Employer shall in
any way release us from any liability under this Guarantee.

Giá trị bảo lãnh theo Thư bảo lãnh này sẽ được giảm dần tương ứng với số tiền tạm ứng mà Chủ đầu
tư thu hồi qua các kỳ thanh toán quy định của Hợp đồng sau khi Nhà thầu xuất trình văn bản xác
nhận của Chủ đầu tư về số tiền đã thu hồi trong các kỳ thanh toán.

The guarantee amount shall be progressively reduced by the amount of advance payment that the Employer
deducted/withdrawn through payment installations under the Contract after the Contractor submit the
Employer’s confirmation on the deducted/withdrawn amount in the periods of payment.

Thư bảo lãnh này được phát hành bằng tiếng Việt và tiếng Anh. Trường hợp có bất kỳ sự khác biệt
nào giữa bản tiếng Việt và bản tiếng Anh, bản tiếng Việt sẽ được ưu tiên áp dụng.
This Guarantee is issued in Vietnamese and English. In case there is any discrepancy, the Vietnamese shall
prevail.

Thư bảo lãnh này có hiệu lực kể từ ngày Nhà thầu nhận được khoản tạm ứng theo Hợp đồng cho tới
(This Guarantee takes effect from the date the Contractor fully received the amount of advance payment
under the Contract to) ngày (date)…… tháng (month)……năm (year) …… hoặc khi Chủ đầu tư thu

hồi hết số tiền tạm ứng, tùy theo ngày nào đến sớm hơn (or upon the Employer withdraws the entire of
advance payment, whichever is earlier).
