INTRODUCTION
1. The urgency of thesis
The thesis topic is urgent from three basic reasons: (i) Human
resources in general, industrial human resources in particular are considered
as one of the important and decisive factors in the industrialization and
modernization of the country but the reality has revealed limitations and
shortcomings in quantity and quality in our country today; (ii) Weaknesses,
limitations and shortcomings in terms of state management have affected
the effectiveness and efficiency of state management for High-Quality
Human Resources in general and High-Quality Human Resources in Vinh
Phuc province in particular; (iii) Scientific research activities around the
theme of state management for High-Quality Human Resources in Vietnam
are still quite new and have not really met the requirements. Regarding the
topic, there are many unresolved issues or many research questions that
have not been thoroughly decoded.
2. Objectives and research tasks
2.1. Objectives of the research

Interpretation of theoretical basis under the perspective of the law on
state management of High-Quality Human Resources, assessing the state of
state management of High-Quality Human Resources in Vinh Phuc
province to propose solutions to ensure state management of High-Quality
Human Resources in Vinh Phuc province in time next. Since then, the
author generalized the lessons of state management experience for High-Quality
Human Resources for localities with similar conditions with Vinh Phuc province.
2.2. Tasks of the research
Conduct an overview of research issues related to the topic, point out
issues that the Dissertation needs to continue to study; system and clarify
theoretical and legal issues on state management for High-Quality Human
Resources; Analyzing and evaluating the current status of High-Quality
Human Resources and State management for High-Quality Human
Resources in Vinh Phuc Province, the situation of law enforcement on state
management of High-Quality Human Resources in Vinh Phuc province to
show the limitations and shortcomings of state management of HighQuality Human Resources in Vinh Phuc province.
From the results of theoretical, legal and practical research on state
management of High-Quality Human Resources in Vinh Phuc province,
giving directions and proposing solutions to ensure state management of
High-Quality Human Resources in Vinh Phuc province and generalizing
lessons for Local conditions are similar to Vinh Phuc province.

3. Object and the scope of the thesis research
- Object of the thesis: theoretical, legal and practical issues of state
management for industrial human resources
- Scope of the thesis:
Regarding research contents: The thesis studies the state
management of industrial human resources in accordance with current

Vietnamese law.
About space and time: The thesis has limited research on state
management practices for industrial human resources in Vinh Phuc province
from 1997 to 2017.
4. Methodology and research methods of the thesis
* Methodology
The thesis has a methodological basis that is dialectical materialism
and historical materialism. This is the methodology used in all research
topics of the thesis. The theoretical ideology of the thesis is MarxismLeninism and Ho Chi Minh's thought about the state and law, views of the
Party and the State on human resources to meet the requirements of
industrialization and modernization under the Great Resolution The 6th
National Congress of IXth, IX, X, XI, XII delegates of the Communist
Party of Vietnam.
* Research methods of the thesis
(1) Methods of indirect research through secondary documents;
Methods of analysis and synthesis.
(2) Direct research method through field survey; interview, exchange
and talk with scientists and experts in the field of politics, law, labor and
security; sociological methods ....
(3) Methods of analysis - scientific forecasts and multi-disciplinary
and interdisciplinary system approaches.
5. New contribution to the science of the thesis
Firstly, the thesis has analyzed and clarified the concepts: "human
resources", "industrial human resources" and "state management of
specialized human resources"; point out and analyze the characteristics of
specialized human resources;
Secondly, the thesis has clarified the theory of adjustment of the law
on state management of specialized human resources, the subject of state
management for specialized human resources, contents of state
management for specialized human resources, and state management

methods for specialized human resources.

Thirdly, the thesis analyzes the state management situation of
specialized human resources in Vinh Phuc province in the past time, which
shows the advantages, limitations and causes of them.
Fourthly, the thesis has provided orientation and proposed solutions
and recommendations to ensure state management for specialized human
resources.
Fifthly, from the practice of Vinh Phuc province, the thesis has
generalized the lessons learned in state management for specialized human
resources with reference value for localities with the same conditions as
Vinh Phuc province.
6. The theoretical and practical significance of the thesis
The thesis is a comprehensive and systematic research project on
state management of specialized human resources in terms of theory, law
and practice. With certain contributions, the thesis has supplemented and
theoretically developed theoretical issues about state management for
specialized human resources. The arguments based on the analysis and
evaluation of the thesis are also a reliable basis for comparison and
adjustment of practical implementation of the law on state management of
specialized human resources from the reality of Vinh Phuc province.
The thesis can also be used as a reference in the process of teaching,
studying and researching at universities and institutes specialized in law,
social labor, economic management and public management. , public policy
…. In addition, the thesis is also a useful reference, providing scientific,
practical and specific knowledge for agencies, organizations and individuals
related to state management for industrial human resources.

RESEARCH OVERVIEW
AND THE PROBLEMS RELATED TO THE THESIS
1.1. Research situation of the subjects
1.1.1. Study abroad situation
A number of research projects and documents abroad on state
management in general and state management for human resources and
state management of industrial human resources in particular have been
published as: Articles "Human resource management and strategy", 3rd

edition by Peter Boxall, Professor of Human Resource Management,
University of Auckland, New Zealand and John Purcell, United Kingdom;
The article "What economic integration brings benefits for Vietnam and
ASEAN" by Mr. Yoshiteru Uramoto, Director of ILO Asia-Pacific region;
The article "Towards a European-style human resource management
model", International Business Research Magazine, edition 26, published in
the first quarter, 1995 by Chris Brewster; Article "Education and vocational
training today: challenges and answers" by George Psacharopoulos (The
world Bank, Washington, USA), (Dr. Hoang Ngoc Vinh translated into
Vietnamese); The article "Training loophole - making quality, low labor
productivity is worse and worse", September 2014 Newsletter by ILO
Office in Vietnam; Full report “ASEAN Community 2015: Managing
integration towards better and common prosperity” by the International
Labor Organization (ILO) - Asia Pacific Regional Office - implemented;
Presentation "Chinese Government Human Resource Development
Strategy" by Xiao Mingzheng, Beijing University, presented at the "Public
Administration Reform for Asian Countries" Workshop by the Ministry of
Commerce National organization from April 3 to April 22, 2008 (translated
and edited by author Nguyen Dieu Tu - Ho Chi Minh National Institute of

In general, the above research projects have generalized the basic
issues of industrial production human resources and the requirements and
conditions of influence, ensuring the quality of human resources, especially
through vocational training system. However, the above studies have just
stopped in general research on human resources at macro level or some
aspects of industrial human resource development.
1.1.2. Research situation in the country
Firstly, the research group works on state management

theoretical and practical basis of state management, curriculum"
Vietnamese Administrative Law Nam ”of Law Faculty, Hanoi National

Studies at the "syllabus" level are for reference only for further in-depth
studies.
Especially, there are some in-depth studies on the theoretical and
practical basis of the renovation, improvement and assurance of state
management in terms of market economy development and international
integration. published last time. State-level key scientific topic (KX01.09)
for the construction of the Ninth National Party Congress Document
(2001): "State management in the socialist-oriented market economy in

Vietnam"; Economic doctoral dissertation "Completing state management

Thirdly, the research group studies the theory and practice of state
management of human resources and industrial human resources
Ministerial-level scientific project "State management for human
resource development in Vietnam: Problems and solutions" by Master Ngo
Minh Tuan is the manager; LATS "The role of the state in creating a
premise of human resources for industrialization and modernization in our
country", Ha Quy Tinh, 1999; Law LATS "State management of labor in
enterprises in Vietnam" by author Vu Minh Tien, defending at the Research
Council of Doctoral Dissertation of Vietnam National University in 2011;
Master thesis of public management "State management for human
resources in industrial zones in Vinh Phuc province" by Nguyen Thi Kim
Dung protects at the Master's Dissertation dots Committee of the National
Academy of Public Administration 2017.
In general, the researches in the world and in the country on HighQuality Human Resources and State management for High-Quality Human
Resources show that the research on industrial human resources and State
management for High-Quality Human Resources has been concerned by
management and scientific researchers in social life, production, socioeconomic development.
So far, Vietnam has not yet had any separate legal documents
regulating High-Quality Human Resources. The theory of state

management on High-Quality Human Resources has not been researched by
any project, some works have mentioned some aspects such as the role of
the state in managing and developing human resources in the
industrialization and modernization phase ... Views and internal research

content on High-Quality Human Resources and State management for
High-Quality Human Resources is fragmented, incomplete, unified and
unified management.
1.2. Research results and gaps of the study
1.2.1. Research results
First, about reasoning
The subjects, research works, articles ... of the authors in different
approaches have unified human resources as a concept to refer to human
factors capable of working and associated with labor. in certain periods of
society. HR is an important factor and determines the process of producing
material wealth of society, for social progress.
Managers and researchers have set the criteria for determining and
assessing the quality of human resources in general and High-Quality Human
Resources in particular in terms of physical strength, mental strength,
attitude, behavior, labor discipline ... of children. and affirmed the important
role of vocational education and vocational training for improving the quality
of human resources.
Some research works and documents also provide the concept of
state management for human resources and human resources development
and the role of human resources in developing industrial economy to meet
the requirements of industrialization and modernization of the country.
However, the concept of state management for High-Quality Human
Resources has not been studied, interpreted and mentioned in research
works. The theory of state management for High-Quality Human Resources
is a new content, which has not been studied yet.
Contents, subjects and methods of state management on the fields of
social life have been studied by a number of works and authors. In the field
of human resources management, there are some research projects
mentioned under the view of public management science or some scientific
senses that are not law but not really complete and comprehensive.

Especially, there has not been any research work that directly studies the
content, subjects and methods of state management for human resources
approaching from the law science.
The research results on the role and duties of the State in HRD in the
orientation of human resources development, creating legal and
environmental framework for HRD, regulating human resources

development and testing , monitoring and inspection of law enforcement
policies on human resources development are also mentioned and affirmed
by some research projects, but are not really complete and comprehensive.
The need to have laws to manage human resources in general and
High-Quality Human Resources in particular has started to be a few
research projects mentioned as an influencing factor and necessary for state
management activities for High-Quality Human Resources.
Second, about practice
Some studies have studied the situation of High-Quality Human
Resources, State management activities for human resources as well as
High-Quality Human Resources in particular in a province or city directly
under the central government of Vietnam but there has not been any
scientific work yet.
1.2.2. The research results and the issues that the thesis continues
to study and clarify
The thesis will inherit the research results of the above mentioned
domestic and foreign studies, including:
Firstly, the PhD student continues to inherit the theoretical research
results on human resources and specialized human resources, state
management and state management of human resources of previous studies
to supplement and complete the concepts of human resources and

specialized human resources; inherit research results on the theory of state
management in general to form the concept of state management for
specialized human resources, characteristics of state management for
specialized human resources.
Secondly, inheriting previous studies on the state management
practice by law and law implementation, the role of the state in
development and state management for human resources for the process of
industrialization and modernization in our country.
Thirdly, inheriting solutions to raise awareness for leaders of
government levels, agencies performing the task of state management of
specialized human resources and development of specialized human
resources in Lai Chau, Da Nang, Khanh Hoa and some localities throughout
the country. To explain and find limited causes of state management for
specialized human resources in Vinh Phuc province.
Fourthly, inheriting the overall solution to improve the theory of
specialized human resources and state management for specialized human
resources. Inheriting recommendations on specific solutions to improve the
provisions of the law and state management for the development of
specialized human resources in localities in vocational training to improve

the quality of specialized human resources and the regulations and
regulations of the labor law. ... to formulate complete, additional and legal
solutions on specialized human resources and state management for
specialized human resources.
The issues that the thesis continues to clarify are:
Firstly, the concept and characteristics of industrial human resources;
concepts and characteristics of state management of industrial human
resources;

Secondly, the goal of state management of local specialized human
resources;
Thirdly, factors affecting state management of local specialized
human resources;
Fourthly, the subject, content, methods of state management for
specialized human resources;
Fifthly, the content of adjusting the law on state management for
specialized human resources;
Sixthly, analyzing the factors affecting the state management of
specialized human resources in Vinh Phuc province;
Seventhly, analyzing the status of adjustment of the law on state
management of industrial human resources in Vinh Phuc province;
Eighthly, analyze the situation and propose solutions to ensure state
management of specialized human resources from the practice of Vinh
Phuc province. At the same time, it is suggested that the lessons of state
management of industrial human resources are for reference for localities
with similar conditions to Vinh Phuc province.
1.3. Hypothesis and research questions
1.3.1. Research hypothesis
High-quality human resources play an important role, determining
the success of the industrialization and modernization of the country.
However, specialized human resources and state management for
specialized human resources in the provinces and cities in our country today
are spontaneous, inconsistent, lack of uniformity and exposed many
limitations. Therefore, it is necessary to continue to improve the state
management of specialized human resources (including: improvement of
related mechanisms, policies and laws; organization of state management
apparatus; contingent of civil servants and public employees. and workers
...) in the direction of meeting the requirements of sustainable industrial
development.

First, what are the characteristics of High-Quality Human Resources
and State Management for High-Quality Human Resources?
Secondly, what are the objectives of state management activities for
High-Quality Human Resources?
Thirdly, in what aspects are the contents of the law regulating state
management for High-Quality Human Resources?
Fourthly, how the State of Vietnam needs to improve policies and
laws on High-Quality Human Resources to serve as a basis and basis for
agencies, organizations and individuals to be assigned the right to exercise
state management for High-quality human resources achieve higher
efficiency?
Fifth, how to improve the law on High-Quality Human Resources to
contribute to the development (in terms of quantity, quality, structure) of
High-Quality Human Resources, meeting the human resources
requirements of industrial enterprises as well as improving the quality of
life. of High-Quality Human Resources in Vietnam in general and Vinh
Phuc province in particular?
CHAPTER 2
SOME THEORETICAL ISSUES AND LAWS ON THE STATE
MANAGEMENT FOR INDUSTRIAL HUMAN RESOURCES
2.1. Concepts, characteristics, objectives of state management for
industrial human resources
2.1.1. Concept, characteristics
First, the concept of human resources:
The concept of human resources: Human resources are a part of the
population, capable of working, when reaching the working age, the society

is mobilized into the social labor process to create material and spiritual
wealth for the society.
Second, the concept, characteristics of industrial human resources:
Industrial human resource is a concept used to refer to a part of the
working-age population, capable of working, being educated and
vocationally trained, having industrial skills and manners, .... may mobilize
into the labor process of enterprises in industrial parks in order to develop
the national or local industrial economy.
The analysis of the connotation of the above concept can see that
industrial human resources have the following characteristics:
Firstly, industrial human resources are a part of the population in
working age and capable of working.

Secondly, industrial human resources are a part of the population who
are educated and trained in professional careers.
Thirdly, industrial human resources are a part of the population with
industrial skills and attitudes and working styles.
Fourthly, industrial human resources are a part of the population
mobilized into the labor process in industrial enterprises.
Third, the concept and characteristics of state management for HighQuality Human Resources.
State management for High-Quality Human Resources is the
management activity of state administrative agencies from central to
grassroots level implemented by state power and mainly uses laws to
influence the activities of organizations and units. and individuals to ensure
the development of High-Quality Human Resources and improve living
standards for workers, contributing to sustainable development of a certain
country or locality.
From the connotation of the above concept, it can be seen that state

management activities for High-Quality Human Resources have common
characteristics of general state management and specific characteristics for
industrial human resources.
2.1.2. State management objectives for industrial human
resources
First, ensure the results of state management activities for HighQuality Human Resources.
Second, ensure the cost of state management activities for HighQuality Human Resources.
2.2. Subjects, contents and methods of state management of
industrial human resources
2.2.1. State management subjects for industrial human resources
State management subjects for High-Quality Human Resources
include: (i) State management subjects for High-Quality Human Resources
are state administrative agencies at the central level (including:
Government, Ministries and relevant ministerial agencies); (ii) State
management subjects for High-Quality Human Resources are state
administrative agencies in the locality (including: People's Committees and

2.4. Law regulating state management of industrial human
resources
2.4.1. Concepts and characteristics of the legislation governing
state management of industrial human resources
Definition: Law regulating state management for High-Quality Human
Resources is the overall legal regulations issued by competent state agencies to
regulate social relations between state management agencies, organizations ,
individuals and people involved in the process of managing and developing
High-Quality Human Resources and ensuring implementation by state
enforcement.
As a part of the Vietnamese legal system, the law on High-Quality
Human Resources also has its own characteristics, which are expressed as

follows:
First, the law on state management for High-Quality Humanities is
issued by competent state agencies, in which the main subjects are state

management agencies with management functions on education and
vocational training, labor .. .. promulgate.
Secondly, the law on state management for High-Quality Human
Resources regulates social relations arising in the state process by legal
tools to ensure the construction, development and use of human resources
for industrial development purposes.
Thirdly, the Law on High-Quality Human Resources is a tool of state
administrative management in creating resources, developing and using human
resources for industrial economy, the main subject of adjustment related to
people in the vocational orientation vocational training for the residential sector
and managing them as employees in industrial enterprises in the localities.
2.4.2. The legal system regulates the state management of
industrial human resources
The legal system regulating state management of industrial human
resources from local practice in Vinh Phuc province includes: (i)
Constitution; (ii) Laws and laws (hereinafter referred to as laws),
resolutions of the National Assembly and the National Assembly Standing
Committee; (iii) Government Decree; (iv) Decision of the Prime Minister;

- Law on adjustment of state management objects for High-Quality
Human Resources.
- Law regulating state management methods for High-Quality Human
Resources.

CURRENT SITUATION OF STATE MANAGEMENT FOR
INDUSTRIAL HUMAN RESOURCES IN VINH PHUC PROVINCE
3.1. Adjusting the law on state management of industrial human
resources in Vietnam today
3.1.1. Adjust the law on the subject of state management for
industrial human resources
First, adjust the law on the subject of state management for industrial
human resources at the central level
In Chapter VII (from Articles 94 to 101), the 2013 Constitution
provides for the position, structure, organization, functions, duties and
powers of the Government.
On the basis of the Constitution, the Law on Organization of the
Government and the General Decree on ministries and ministerial-level
agencies, which are specialized agencies of the Government, the
Government promulgates decrees and regulates functions in detail. ,
specific tasks and powers of each ministry and ministerial-level agency on
management of branches and domains.

Secondly, adjust the law on state management of industrial human
resources in the locality
In the construction and organization of the operation of the state
management apparatus for High-Quality Human Resources in the locality,
Vinh Phuc province has focused and seriously implemented and
implemented the provisions of the law on the organization of state
apparatus. in general and state management for High-Quality Human
Resources in particular in the province.
The provisions in legal documents detailing or guiding the construction
and organization of the state administrative apparatus in the locality,
including: Law on organization of local governments in 2015; Decree
24/2014 / ND-CP regulates the organization of professional agencies under
the People's Committees of provinces and cities directly under the Central
