PREAMBLE
1. Urgency of the subject
Vietnam is on the path of building a SOC rule of law state of the
people, by the people, for the people, and building SOC democracy. It
should also be spread into a democracy movement in Vietnam.
SAA is a facility where democratic activities take place. In the
SAA, the people who implement the law on GD are all subjects, from
managing subjects to cadres, civil servants and workers. Each subject has
rights and obligations corresponding to its position and role. In the SAA,
the effective implementation of the law on GD can create a democratic
working environment, promote the strength of workers, unite all people in
the agency; against the situation of "lack of democracy", "antidemocracy", abuse of power and imposition of some individuals
(especially individuals holding important positions in the agency);
restricting the status of group benefits and faction in the agency; is the
basis for building "service administration", providing the best public
services for people. A SAA without democracy in organization and
operation will be an environment to nurture "revolutionary officials",
corruption, bureaucracy ...
In recent years, the SAA in general and the SAA in Thai Nguyen

province in particular have paid attention and focused on the
implementation of the law on GD in the agencies. Many administrative
offices have created an open, democratic environment, creating motivation
for CCS to maximize their capabilities and increasingly attach to the
agency. However, the reality shows that there are still many problems and
limitations for the implementation the law on GD in general and in the
SAA in particular. There are still many undemocratic manifestations in the
system of SAA, affecting the building of a democratic environment in
agencies.

Speeding up the implementation of the law on GD in the SAA in
the current period is both a task and a need of the SAA and CCS in the
agency. The expansion of democracy will not only contribute to building a
stronger SAA but also help CCS be promoted their ability, intelligence
and strength to devote to the work.
2. Research purposes and tasks of the thesis
2.1. Research purposes
On the basis of clarifying the theoretical issues on the
implementation of the law on GD in the SAA and the reality of law
implementation in the SAA in Thai Nguyen province, the thesis aims to
propose solutions to strengthen the implementation of the law on GD in
the SAA in the current period.
2.2. Research tasks
- From understanding the research works of domestic and foreign
authors on the implementation of the law on GD in the SAA, evaluating
the overview of research issues in terms of theory, current situation and
solutions; Since there, draw out the contents that have been thoroughly
studied, can inherit, the contents still need to be further studied and

clarified in the thesis.
- To clarify theoretical issues related to the thesis subject, unify
the concept of "implementation of the law on GD in the SAA"; to study
the

content, implementation form and

issues of

ensuring the

implementation of the law on GD in the SAA.
- To study the actual situation of implementation of the law on
GD in the SAA in Thai Nguyen, to analyze the achieved results,
limitations and causes.
- To propose solutions to enhance the implementation of the law
on GD in the SAA in accordance with reality.

3. Research object and scope of the thesis
- Research object: The research object of the thesis is a matter of the
implementation of the law on GD in the SAA; activities of the implementation
of the law on GD in the SAA.
- Research scope
About space: In the SAA; in particular, the research space is the SAA
in Thai Nguyen province.
About time: The thesis conducts research and data collection over a 5year period (from 2015 to 2019).
About content: The thesis focuses on studying the implementation

of the law on GD in the local SAA, including People's Committees at all
levels and departments, divisions and boards.
4. Methodology and research method of the thesis
4.1. Methodology
The thesis is based on the methodology of historical materialism,
dialectical materialism; Marxism-Leninism, Ho Chi Minh ideology, the
Party's views on democracy, implementation of the law on GD in the
SAA.
4.2 Specific research method:
Methods of historical research; integrated approach; comparative
method; analytical method.
5. New contributions to the science of the thesis
The thesis contributes to clarify some theoretical contents of the
implementation of the law on GD in the SAA: building up the concept of the
implementation of the law on grassroots democracy in the SAA; to point out the
content, form, characteristics, roles and factors to ensure the implementation of
the law on GD in the SAA.
The thesis initially assessed the current status of the implementation of
the law on GD in the SAA in Thai Nguyen in recent years and practical

guarantees for law implementation; pointed out and analyzed the causes and
influencing factors leading to the achievement and limitations in the
implementation of the law on GD in the SAA.
The thesis stated and analyzed the needs and proposed solutions to
enhance the implementation of the law on GD in the SAA in the current period
in Vietnam in general and Thai Nguyen province in particular.
6. Theoretical significance and practical significance of the thesis
- Theoretical significance: The research results contribute to

clarify some theoretical issues about the implementation of law on GD in
the SAA that the previous studies have not clarified such as the concept,
characteristics, the role of the implementation of the law on GD in the
SAA, ensure the implementation of the law on GD in the SAA...; enrich
theoretical contents on the implementation of the law on GD.
- Practical significance: The thesis identifies posed issues and
basic solutions system to promote the implementation of the law on GD in
the SAA in the coming time. The thesis can be a reference for managers in
the process of organizing the implementation of the law on GD in the
SAA.
7. Structure of the thesis
In addition to the Preamble, Conclusion and Reference, the thesis
consists of 4 chapters.

Chapter 1
OVERVIEW OF RESEARCH SITUATION
The number of research results related to the thesis subject is
large, including domestic and foreign research, approach and exploitation
of issues from different directions, many different aspects, providing
important knowledge about democracy, GD, law on GD, democratic
implementation, GD implementation, improving the effectiveness of the
law on GD in the SAA.
In addition to studying and clarifying theoretical issues about
democracy and grassroots democracy, direct democracy, the author also
focuses on the implementation of the law on grassroots democracy in a
certain specific locality or area (plain area, mountainous area, rural area),
drawing a colorful picture of the implementation of the law on GD in

Vietnam; shows that the implementation of the law on GD in Vietnam has
made many achievements, contributing to bringing true ownership to the
people. The research projetcs also focus on summarizing practices,
assessing the status of the implementation of the law on GD and proposing
solutions to improve the quality of of the implementation of the law on
GD in the next period. Among them, the implementation of the law on GD
in communes, wards and towns is the most exploited content.
However, there are still contents that the authors have not studied
thoroughly such as: There are very few researches on GD in the SAA and
the implementation of the law on GD in the SAA; No author has
completely developed the concept of implementation of the law on GD in
the SAA, characteristics and issues of ensuring the implementation of the
law on GD in the SAA. No project has focused on separate research on the
situation as well as proposing solutions to implement the law on GD in the
SAA

Issues for research, research question, research hypothesis
Issues for research include:
- Clarifying concepts and characteristics of the implementation of
law on GD in the SAA, showing the similarity and difference between the
implementation of law on GD in the SAA in communes, wards, towns and
enterprises; the role of the implementation of law GD in the SAA and
issues related to ensuring the implementation of law GD in the SAA.
- Showing contents and forms for the implementation of law on
GD in the SAA; ensuring the polical, legal and social aspects, etc. for the
implementation of law on GD in the SAA.
- Actual situation of the implementation of law on GD in the SAA
in Thai Nguyen province and solutions to enhance the implementation of

the law on GD in the SAA.
The thesis should focus on clarifying some research questions as
follows:
- What is the implementation of law on GD in the SAA?
- What is the specific content about the implementation of law on
GD in the SAA? How is the content done? What factor is the content
assured for implementation by?
- What is the practice in the implementation of law on GD in the
SAA in Thai Nguyen province in recent years? Achieved result, limitation
and cause?
- What is the solution to enhance the implementation of law on
GD in the SAA in Thai Nguyen province?
Based on the research question, hypothesis in this research:
- The implementation of law on GD in the SAA is a process
attended by agencies and organizations, which is clearly determined
through the leadership activities, providing specific guidance to implement
law, organizing the implementation of law and implementing law based on

subjects; The implementation of law on GD in the SAA requires the
participation of many new subjects for better performance, especially
CCS; claims a comprehensive aspect on economy, politics, society, etc.
- The implementation of law on GD in the SAA is increasingly
paid attention; gaining many achievements in enhancing democratic
relations in the agencies ... However, there are still many existing
limitations which originate from many causes, among which, the main
cause is CCS.
- To enhance the implementation of law on GD, it is required a
comprehensive solution system, from economical solution, political

solution, legal solution, etc., to specific solutions for different subjects
such as the Party’s organizations, socio-political organizations in agencies,
heads, CCS in agencies, etc.

Chapter 2
THEORIES OF IMPLEMENTATION OF THE LAW ON
GRASSROOTS DEMOCRACY IN STATE ADMINISTRATIVE
AGENCY
2.1. Concept of implementation of the law on grassroots democracy in
state administrative agency
2.1.1. Grassroots democracy and law on grassroots democracy
- Democracy and grassroots democracy
Democracy is the power that belongs to the people, is a form of
state organization, a political - social regime, in which legal recognition of
basic human rights (freedom, equality). Democracy is also a way to
exercise the rights of citizens, a way to legally and effectively implement
the organization's activities. Democracy is understood as the rights of
communities and collectives but also understood as the rights of individual
citizens.
GD means the people are the owners, the people are the masters in
the communes, wards and towns; SAA and non-business units; enterprises,
cooperatives ... through the implementation of the right to know, the right to
discuss, the right to participate, decide and supervise ... In which,
"grassroots" are understood as units at the bottom of all administrative levels
(grassroots - commune level), where labor, production activities are carried
out (at offices, units, schools, hospitals, enterprises ...).
- Law on grassroots democracy

The implementation of GD is conducted in accordance with the
law on GD. The law on GD is a system of rules of conduct issued by a
competent state agency, which recognizes people's ownership of
grassroots level, the organization and implementation of GD; to ensure
real ownership of citizens in different types of facilities.

Law on GD exists as a system. These include general legal
documents governing democracy (such as the Constitution, related laws
...) and separate legal documents specifically for GD with each other
"grassroots" type (Eg: SAA; communes, wards, towns; enterprises,
cooperatives) In which, the SAA is one of the "grassroots" type that takes
place in implementation of the law on GD, according to the law on GD in
the SAA.
2.1.2. Law on grassroots democracy in state administrative agency
- State administrative agency
Within the scope of the thesis, the research focused on the SAA is
People's Committees at all levels (provincial, district and communal levels)
and SAA with professional competence in localities including departments
and equivalent units; divisions and equivalent units. Along with the state
competent SAA, the specialized SAA are also the facilities where the law on
the GD is implemented.
- Law on GD in the SAA
The law on GD in the SAA has a very wide scope of regulation,
reflected in all areas of state management of the SAA; It is in various
documents, from the highest legal document that is the Constitution, to the
legal documents, sub-legal documents, issued by competent agencies from
central to local.

The content of the law on implementing GD in the SAA focuses
on stipulating principles and mechanisms of exercising democracy in the
operation of the SAA, the functions, tasks and powers of the SAA and the
matters of supervision, inspection and control... the performance of duties
and powers of the heads and competent persons in the SAA; provisions on
the implementation of democracy in the SAA include CCS exercising the
right to ownership in the SAA (performing their obligations, performing
their rights to know, be discussed, done, inspected, supervised ...) with the

order, procedure, form, manner and condition of implementation; The
SAA exercises ownership in the relationship with the superior and
subordinate agencies.

2.1.3. Implementation of the law on grassroots democracy in state
administrative agencies
- Concept: The implementation of the law on GD in the SAA is the
process of actually implementing the provisions of the law on grassroots
democracy in the SAA, reflected through the exercise of the rights to
know, be discussed, done, inspected, supervised of CCS; thereby,
promoting the ownership of CCS in the agency, promoting creativity in
the organization and operation of the SAA, meeting the requirements of
building the socialist rule-of-law State of the people, by the people and for
the people under the leadership of the Communist Party of Vietnam.
- Characteristics of implementation of the law on GD in the SAA:
The implementing subject has a high and uniform legal knowledge and a
sense of exercising the right to ownership; Always go hand in hand with
ensuring administrative order, ensuring the principle of democratic
centralism and obedience orders; To comply with legal regulations;

associated with the performance of functions and tasks of the agency; To
pay attention to direct democracy so CCS can directly discuss and decide
issues related to their rights and obligations; To be conducted under the
leadership of the Party, with the active participation of the unions in the
agency.
- The role of the implementation of the law on grassroots
democracy in state administrative agencies: Implementation of the law on
GD in the SAA is actually implementing the specific provisions on
socialist democracy in the SAA; To contribute to improving the quality of
CCS in the agency, to promote the ownership of the CCS, raising the
responsibility of leading officials to build a qualified and ethical CCS; to

build a democratic agency environment; to contribute to fight against
power abuses, extravagance, and law violations in agency; To contribute
to promoting administrative reform.
2.2. Contents and forms of implementation of the law on grassroots
democracy in state administrative agencies
2.2.1 Contents of the implementation of the law on grassroots democracy
in state administrative agencies
- Contents of the implementation of the law on grassroots
democracy within state administrative agencies
Content of implementation of rights: Democracy in the SAA is
always associated with specific contents related to the activities of the
agency and expressed directly in the democratic rights of CCS. It is the
right to know what is related to the operation of the agency, the right to
contribute opinions, the head of the decision-making body and the right to
supervise and inspect.
Content of implementation of obligations: The law clearly defines

the responsibilities of the heads of agency, the responsibilities of CCS and
the responsibilities of entities in the implementation of the provisions of
the order, procedures and other conditions.
- Contents of the implementation of the law on grassroots
democracy in relation to other agencies, organizations and individuals
Content of exercise of rights: In relation to other agencies,
organizations and individuals, the implementation of the right on GD in
the SAA is expressed in the following contents: the right to access
information, the right to supervise inspection, the right to participate
opinion, the right to make decisions ...
Content of implementation of obligations: Performing the legal
obligation on GD in relation to other agencies, organizations and
individuals, including: the obligation to settle according to its competence

for the requests of citizens and organizations; information disclosure
obligations;

supervision

and

inspection

obligations;

coordination

obligations; responsibility to handle violations according to their

competence.
2.2.2. Forms of implementation of the law on grassroots democracy in
state administrative agencies
The law on GD in the SAA will be realized in life through the
following forms (ways): to fulfill the obligation to disclose information
and to exercise the right to known in the form of publicity; Forms of
giving opinions (directly or indirectly), forms of supervision and
inspection (through activities of People's Inspection Boards of the agency;
through review, criticism and self-criticism; through a CCS conference of
the agency).
2.3. Ensuring the implementation of the law on grassroots democracy
in state administrative agencies
2.3.1. Economic guarantee
In order to ensure the implementation of the law on GD in the SAA, a
sufficient and convenient material foundation must be built for practical
implementation of the law. Assurance of adequate funding for the
dissemination and education of the law on democracy, GD, GD in the SAA;
for the implementation of programs and plans; for organizing campaigns; for
the provision of material and technical facilities in service of information and
access to information of CCS, agencies, organizations and people; for the
provision of modern and civilized office equipment; for ensuring the life and
material benefits meeting the basic requirements of CCS; for the work of anticorruption, inspection, examination ... will be both a foundation and a
motivation to push the legal process into life.
2.3.2. Political guarantee

The development of a legal culture in the SAA is an essential
condition for organizing the effective implementation of the law on GD.

To approve leaders to implement the law on GD in the SAA
through the lines, guidelines and policies on the GD; propagandizing,
mobilizing, inspecting, supervising and exemplifying activities of party
members ..., grassroots party organizations ensure that the organization of
law enforcement on GD in agencies takes place in line with the law.
The opinions of the Veterans' Union, Trade Union, Youth Union
and People's Inspection Committee in the SAA is considered the opinions
of a group of members. CCS as members of these organizations can
exercise their democratic rights within the framework of their operations.
Interest groups can also promote a democratic process, and
promote the implementation of the law on GD to achieve their interests.
2.3.3. Legal guarantee
In order to implement the law on GD in the SAA, it is necessary to
have a complete legal system on GD in the SAA to meet the requirements of
legality and rationality; that is suitable for the specific circumstances of the
SAA in Vietnam in the current period.
2.3.4. Social security
Social security for the implementation of the law on GD in the
SAA includes assurance within the agency (building organizational
culture) and ensuring relationships with agencies, organizations and
people in working system.

Chapter 3
ACTUAL SITUATION OF IMPLEMENTATION OF THE LAW ON
GRASSROOTS DEMOCRACY IN STATE ADMINISTRATIVE
AGENCIES IN THAI NGUYEN PROVINCE
3.1. The Party's views on implementing grassroots democracy in state

administrative agencies and current laws on grassroots democracy in
state administrative agencies
2.1.1. The Party's views on implementing grassroots democracy in state
administrative agencies
The Communist Party of Vietnam always affirms that democracy
is the goal towards and building socialist democracy is an extremely
important task. Our Party's views on democracy are constantly evolving in
the process of leading the country to build socialism and conducting
renovation. This is reflected in the Party's documents, resolutions,
guidelines and policies so far.
The Politburo and the Secretariat in each specific period promptly
issued documents related to the implementation of democratic regulations
such as: Directive No. 30-CT/TW dated February 18th, 1998 of the
Politburo. (term VIII) on the development and implementation of the
Grassroots Democracy Regulation; Directive No. 10-CT/TW dated March
28th, 2002 of the Secretariat continued to promote the establishment and
implementation of the Grassroots Democracy Regulation; Conclusion No.
65-KL/TW dated March 4th, 2010 of the Secretariat on the continued
implementation of the Politburo's Directive No. 30-CT/TW dated
February 18th, 1998 (Term VIII) on development and implementation of
the Grassroots Democracy Regulation. Most recently, on January 7 th,
2016, the 11th Politburo issued Conclusion 120 on continuing to promote
and improve the quality and effectiveness of the establishment and
implementation of the Grassroots Democracy Regulation.

2.1.2. Current laws on grassroots democracy in state administrative
agencies
The provisions of the Constitution, especially the Constitution in

2013, emphasize the ownership of the People, expressed in Article 2,
Article 6. Based on the provisions of the Constitution, the system of
organizational laws , state administrative agencies (including: Law on
Organization of the Government in 2015, Law on Organization of local
government in 2015) ...; documents guiding the implementation of specific
provisions on organizational structure, functions, tasks, operational
principles, working relationships between SAA; legal documents, sublegal documents on the performance of specific functions, tasks and
powers of the SAA such as the Law on Complaints (2011), the Law on
Denunciations (in 2018), the Law on Access to Information ( 2016), ...
The Government has issued decrees to implement democracy in
various types of agencies: Decree No. 71/1998/ND-CP dated September
8th, 1998 promulgating the Regulation on the exercise of democracy in
activities of the agency, Decree No. 04/2015/ND-CP on the Regulation on
exercising democracy in state administrative agencies and public nonbusiness units, replacing Decree No. 71/1998/ND-CP; Ministry of Home
Affairs issued a Circular guiding the contents of Decree No. 04/2015/NDCP.
3.2. Overview of the current socio-economic situation and the system
of state administrative agencies in Thai Nguyen province.
3.2.1. Overview of the socio-economic situation in Thai Nguyen province
in recent years
There are 09 district-level administrative units (02 cities, 01 town,
06 districts) and 180 communes, wards and towns in Thai Nguyen. The
province has a lot of potential for socio-economic development. In recent
years, Thai Nguyen province has achieved remarkable results in socio15


economic development, exceeding the objectives and tasks of socioeconomic development and national defense, security, improving people's
lives.
3.2.2. System of state administrative agencies in Thai Nguyen province
At the provincial level, the SAA with common competence are the
People's Committee of Thai Nguyen province and the SAA with

professional competence are organized in accordance with the Decree No.
24/2014/ND-CP dated April 4th, 2014 of the Government stipulating the
organization of professional agencies under the People's Committees of
province and centrally-run cities, including departments and equivalent
units
At the district level, the SAA has the common competence of 9
district-level People's Committees and the SAA with professional
competence organized according to Decree 37/2014/ ND-CP of May 5th,
2014 of the Government regulating specialized agencies of People's
Committees of districts, urban districts, cities and towns under provice.
The commune-level SAA is the People's Committee of the
commune. As of 2019, there are currently 180 state-owned administrative
agencies being communal People's Committees in the communes, wards
and towns.
3.3. Actual situation of implementing laws on grassroots democracy in
state administrative agencies in Thai Nguyen province in the period of
2015-2019
3.3.1. Some results achieved in the implementation of the law on
grassroots democracy in state administrative agencies in Thai Nguyen
province
- Results of the implementation of the law on GD in the SAA of
Thai Nguyen province

Achievements on the implementation of the law on GD within the
SAA: Every year, 100% of the SAA in Thai Nguyen province organized a
CCS conference as prescribed. Many agencies have actively and publicly
made information related to organizational structure, staff organization,

and staff work. The activities of the people's inspection board in the SAA
continued to make more changes; fulfilling the supervisory role to
contribute to strengthening and promoting the implementation of
democracy in agencies. Accountability within the SAA is implemented in
accordance with the law. The administrative reform, civil service regime
reform continue to be promoted by the SAA in the province. The reception
of

people,

the

settlement

of

complaints,

denunciations

and

recommendations of CCS: continued to have positive changes.
Results of the implementation of the law on GD in relation to
related agencies, organizations and individuals: The SAA in the province
have strictly implemented the public posting of information, ensuring the
right to be discussed, be contributed opinions of people; actively deploying
the direct contact and dialogue of the heads of party committees and
administrations at all levels with the people; promote settlement of
complaints and denunciations; actively implement accountability. All SAA

have applied the implementation of one-stop shopping and connected onestop shopping to provide online public services.
- Cause of the results achieved: Democratic tradition and strong
sense of ownership of CCS and people in Thai Nguyen province; The
direction and organization of the implementation of the Thai Nguyen
Provincial Party Committee and People's Committee; The belief of CCS in
the results of the implementation of the law on the GD in the SAA; The
socio-economic development of the province in recent years
3.3.2. Restrictions in the implementation of the law on grassroots
democracy in state administrative agencies in Thai Nguyen province

- Restrictions in the implementation of the law on grassroots
democracy in the state administrative agencies of Thai Nguyen province
The implementation of the law on GD within the SAA of Thai
Nguyen province still has the following limitations: The quality of the
majority of conferences is unsatisfactory and formal. Activities of People's
Inspection Boards in some agencies have not fully promoted their roles
and responsibilities, effectiveness is still low. The promulgation and
concretization of tasks and solutions in implementing regulations and
guidance on the implementation of the law on GD of some agencies are
limited, not timely, asynchronous. The handling of complaints and
denunciations is still a long-term case. A part of CCS showed signs of
democratic violations, irresponsibility in dealing with cases involving
CCS, thus reducing the confidence of CCS and people.
The implementation of the law on GD in the relationship between
the SAA and other individuals and organizations also has some basic
limitations: Some of the SAA still have the form, the state of losing
democracy, violating the people's ownership, disrespecting the people.
The publicity of programs, schemes, projects, planning, land use plans ...

in some localities, units has not been strictly implemented, not in
compliance with the regulations. Some SAA also have cumbersome and
troublesome administrative procedures. The effectiveness of the
implementation of accountability of the SAA through the mechanism of
accountability inspection has not been well implemented ...

Cause

of

the

restrictions:

Awareness

of

democracy,

implementation of law on GD in the SAA in some CCS is limited.
Psychology of fear of collision, obedience habits of CCS; The direction
and organization of implementation in some SAA are still not good;
Information and propaganda about policies and laws on GD has many

limitations; The lack of drastic and coordinated activities among political

and socio-political organizations in implementing the law on GD.
Chapter 4
NEED AND SOLUTION TO STRENGTHEN THE IMPLEMENTATION
OF LAW ON GRASSROOTS DEMOCRACY IN STATE

4.1. Need to strengthen the implementation of the law on grassroots
democracy in state administrative agencies
Strengthening the implementation of law on democracy in the
SAA is the need of the SAA, an urgent and legitimate need of each CCS in
the SAA, and, a mandatory requirement to improve the State’s
management efficiency and social life.
4.2. Solution to strengthen the implementation of law on grassroots
democracy in state administrative agencies
4.2.1 Completing the law on grassroots democracy in SAA
- Promulgating legal documents which have high legal effect on
the implementation of GD in SAA.
- Completing regulations on ensuring the implementation of
mastery of CCS in SAA.
- Completing regulations on the implementation of law on GD
in the relationship between SAA and other agencies, organizations as
well as citizens.
4.2.2. Strengthening leadership and organizing the implementation of
law on grassroots democracy in state administrative agencies

to

organize

the

implementation of law on GD in SAA. Namely: Promoting democracy in
the Party; the Party executive committee levels to strengthen the leadership in
completing the GD in SAA; Promoting the role of cadres and party members;

Strengthening the inspection, supervision and evaluation to the result of
implementating party committees and party cells in SAA; In personnel
planning, seeing the content for well implementing general law and law on
GD in SAA, in particular is a mandatory criterion.
- Strengthening the implementation of the law on GD in SAA:
Strengthening, promoting the role and activities of the Steering Committee
in implementing regulations on GD at levels, People’s Inspection Boards
in SAA; Concretize the implementation of law on grassroots law in SAA;
Associate the implementation of law on grassroots law in SAA with the
implementation of functions, tasks and public administration reform of the
agencies; Strengthening the information disclosure and transparency of
policies and laws in SAA
4.2.3. Improving the sense of law, mastery of cadres and civil servants in
state administrative agencies

- Improving the sense of law, focusing on improving knowledge and
law on GD for CCS in SAA
- Improving skills to implementing legal rights and obligations on
GD of CCS in SAA.

4.2.4. Strengthening inspection and supervision to the
implementation of the law on grassroots democracy in state
administrative agencies

- Strengthening inspection: synchronously conduct internal
inspection of higher-level SAA and lower-level SAA and inspection
activities of inspection agencies.
- Strengthening supervision: Carry out supervision in various
manners, promoting the role of the entire political and social the role of
citizens, including: Strengthening the supervision of people, People's
Council at levels for the implementation of GD in SAA.

4.2.5. Well handling the claim and denunciation of cadres, civil servants;
strictly and clearly handling violations to law on grassroots democracy in
state administrative agencies
- Well handling the claim and denunciation of CCS about
violations to law on GD in SAA: For achieving the purpose, strengthen
reconciliation at grassroots level, consolidate citizen reception staffs;
strengthen the reception of citizens; promote the inspection to handling
claim and denunciation.
- Strictly and clearly handling violations to law on GD in SAA
(especially, violations of leaders and competent persons in SAA).

4.2.6. Strengthening the implementation of grassroots democracy and
ensuring benefits (especially, material benefits) for cadres and civil
servants.
To eliminate the cause resulting in democratic abuse for seeking
profit, violating law on GD, it is necessary to have an appropriate policy to
improve the income of CCS in the SAA, to reform salary policy, ensuring
ensure income, basically meet the material needs of CCS.
4.2.7. Building criteria and effective measure for the implementation of
law on grassroots democracy in state administrative agencies
Now, it is difficult to evaluate the implementation of the law on
GD in SAA because the measure is not detailed; Mostly, it is judged on
the general expression but not on the different levels to distinguish it. It is

necessary to continue building, supplementing and completing criteria,
standards for evaluating the results of implementation of the law on GD in
SAA to grade, evaluate, comment on annual emulation and classification
for localities, agencies, units to ensure closeness to the reality,
effectiveness and feasibility.
4.2.8. Some specific solutions in promoting the implementation of the
law on grassroots democracy in state administrative agencies of Thai
Nguyen province in the coming time
- Promote the propaganda, fully and strictly comply the
guidelines the Party, the policies and law of the State on establishment and
implementation of GD, of which the Party’s opinion mentioned in
Directive 30, Conclusion no. 120; Decree no. 04, Circular no. 01, etc, is
focal.
- The Executive committee of the provincial party should strengthen
to provide specific guidance for SAA to implement the law on GD

associated with the implementation of directives, resolutions on founding
and regulating regulating the Party, the implementation of objectives and
tasks for socio-economic development, ensuring national defense and
security in the locality; continue to provide specific guidance for control,
amendment, supplement, foundation and promulgation of regulations on
the implementation of grassroots democracy ...
The Provincial People’s Committee should promptly issue
necessary plans, guidelines, regulations, etc. to ensure the uniform and
effective implementation of the law on GD in the SAA; regularly carry out
inspection; speed up the settlement of complaints, denunciations, handle
petitions and judgments of CCS and people on violations to democracy
and law in the SAA.
- The SAA shall concretize the content of the law on GD in the
SAA into specific requirements, regulations and criteria of emulation; be

impartial and objective in assessment; apply reward and discipline for
individuals gaining achievements or violating the law on GD in the
agencies.
- Socio-political organizations in the SAA shall continue renovating
the content and method of operation; well performing its function as
representatives, protecting the legitimate rights and interests of union
members, members and people; propagandizing and ancouraging CCS to
well implement guidelines of the Party, policies and laws of the State.
Promote the supervisions, social criticism, etc.
- Focus on building a group of CCS by improving capacity, public
service morality, full and comprehensive knowledge in the implementation
of the law on DG in the SAA.
