Lacking regulations and employee welfare avoidance are current problems in
sharing economy. In this economy, participants probably provide the same
products and services compared to other existing businesses in the market,
but they seem less controlled or non-controlled by recent regulations and
laws. This is because all transactions in the sharing economy are in the digital
platform, thus, there is no evidence or legal documents provided for
government management (Neuberger 2019). Even though many opinions
argue that the government must have a new regulation to control the market
activities and avoid unfair competitions, the Institute of Public Affairs (2014)
states that private problem-solving improvements and bottom-up regulation
control are more likely to address the issue than government control. It is not
necessary to have a new law for an uncertain future of the peer-to-peer
economy because it has different characteristics and issues with the
traditional economy (The Institute of Public Affairs 2014). Thus, entrepreneurs
in the sharing economy must find innovative solutions to overcome selfhindrances and be more principled. Another problem is the fraud following the
labor law. The other problem is the fraud following the labor law. Theoretically,
the participants in this economy are not employees but independent providers
(Erickson and Sørensen 2016, p.6), and therefore, these providers are not
objecting of the labor law. As a result, business owners can avoid paying
overtime wages and the correct wages rate by which they can probably raise
the business profits. To overcome this problem, the Department of Labor
would classify the independent contractors as dependent ones and give
guidance about which protections are extended for them, for example, the
right to pay minimum-wage and overtime eligibility (Zacharias 2018). To sum
up, the sharing economy is not a disadvantage to the sustainability of the
economy; however, it needs further adjustments to be more sustainable over
the developing process.
